PPOs Against Minors

You are filing for a PPO against a minor child.  In order to file for a PPO against a minor, the minor child must be at least 10 years old, but less than 18 years old.  If they are under 10 years old, you cannot file for a PPO against that child.

If you are filing for a PPO against a minor child, you will first need to know what type of PPO you need to file for.  To make this determination, see below:

 

A. Domestic PPO against a minor: If you are filing to protect yourself (or filing on behalf of a minor child or a legally incapacitated person to protect that person) against a minor between the ages of 10-17, and if any of these are true:

 

  1. The person to be protected lives with or has lived with the minor you are filing against at any point in time.

  2. The person to be protected has or is currently dating the minor you are filing against.

  3. The person to be protected has a child together with the minor you are filing against.

If none of these apply, go to section B.

 

B. Non-domestic PPO against a minor: If you are filing to protect yourself (or filing on behalf of a minor child or a legally incapacitated person to protect that person) against a minor between the ages of 10-17,  and if ALL of these are true:

 

  1. The person to be protected has never lived with the minor you are filing against at any point in time.

  2. The person to be protected has never had a dating relationship with the minor you are filing against.

  3. The person to be protected has never been married to the minor you are filing against.

  4. The person to be protected does not have a child together with the minor you are filing against.

  5. This matter does not involve a sexual assault or a threatened sexual assault or the furnishing of obscene material to a minor.

But if any of these are not true then you should be filing for a different PPO.  If one or more of the domestic relationships exists between the parties in 1-4, scroll back up to letter A and click on the link for A. 

 

If the domestic relationship does not exist but the person seeking protection needs it because of a sexual assault or threatened sexual assault or because the Respondent has shown a minor protected party obscene material, scroll down to letter C and click on the link.

C. Non-domestic sexual assault PPO against a minor: If you are filing to protect yourself (or filing on behalf of a minor child or a legally incapacitated person to protect that person) against a minor between the ages of 10-17 who has:

  1. sexually assaulted the person needing protection AND/OR

  2. threatened to sexually assault the person needing protection AND/OR

  3. has furnished obscene material to the minor child needing protection

 

AND the person needing protection

 

  1. has never lived with that minor AND

  2. has never had a dating relationship with that minor AND

  3. has never been married to that minor AND

  4. does not have a child together with that minor
